Dear Customer;
The State of California has passed legislation establishing a funding system for
the collection and recycling of certain electronic wastes. This law (the Electronic
Waste Recycling Act of 2003) requires manufacturers and resellers of certain consumer
and non-consumer products sold to California end user purchasers to do certain things.
Currently only certain display products are covered by the statute. It is anticipated
that other products will be added in the future.
First, Section 42465.3 states that
, a manufacturer shall inform the retailer if
a covered electronic device sold by that manufacturer is subject to the covered electronic
waste recycling fee established pursuant to this chapter.
Second, starting with sales on or after January 1, 2005, the retailer or other
direct seller must impose the following fees, payable to the California fund, based
on the screen size of the display:
Display Screen Size, Measured Diagonally Fee
>4<15 $6.00
>15<35 $8.00 equal to or
>35 $10.00
Each retailer needs to review the law and regulations for information and
direction on how to collect the fee as well as how to report and remit the fee
to California. For a more complete explanation and guidance go to of the law is
available at http://www.boe.ca.gov/sptaxprog/ewaste.htm.
The following website also has information that will help you with those
matters: http://www.erecycle.org/
Also you can contact the California Department of Toxic Substances Control or the
Integrated Waste Management Board for more information. Obviously, you should consult
with your legal advisor if you have any question about how this law directly affects
you and for updates to it.
